ACCESS TO A DECEASED MINOR CHILD’S DIGITAL ASSETS

That the Virginia General Assembly has enacted legislation that allows personal representatives of a deceased minor to access the child’s digital assets, e.g. social media accounts and other online records and communications. Digital assets of adult decedents remain governed by the applicable Terms of Service Agreement, most of which expire upon the death of the account holder. Regardless of age, digital assets warrant attention and should be addressed in a comprehensive estate plan given the amount of information we now store in various digital formats.
